These Terms of Service ("Terms") govern your use of the KB Tenacious, LLC website located at kbtenacious.com ("Site") and any invoice-tier services you request through it. By accessing this Site or submitting a service request, you agree to these Terms. If you do not agree, do not use this Site or submit any requests.

PART 1 — WEBSITE USE

KB Tenacious, LLC is a licensed private investigation agency operating under Washington State law. Agency License No. DOR00030765. All investigative services are performed by or under the direct supervision of a Washington State–licensed private investigator.
2. NO CLIENT RELATIONSHIP CREATED BY SITE USE
Visiting this Site, reading its content, or submitting a contact form does not create a client relationship, engagement agreement, or any obligation on the part of KB Tenacious, LLC to accept your case or provide services. A client relationship is established only upon execution of a written engagement agreement or, for invoice-tier services, upon KB Tenacious, LLC's written acceptance of your request and issuance of an invoice.
3. INFORMATIONAL CONTENT ONLY
The content on this Site is provided for general informational purposes only. Nothing on this Site constitutes legal advice, professional investigative advice, or a guarantee of any outcome or result. You should consult a licensed attorney for legal matters.
4. PERMITTED USE
You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

Our total liability for any claim arising from use of this Site shall not exceed one hundred dollars ($100.00).
9. GOVERNING LAW
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of this Site shall be resolved in the state or federal courts located in Lewis County, Washington.
10. CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. Changes take effect upon posting to this Site. Your continued use of the Site after any modification constitutes your acceptance of the updated Terms. We will update the "Last Updated" date at the top of this page when changes are made.

PART 2 — INVOICE-TIER SERVICE TERMS
━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━
These terms apply to all services fulfilled under invoice only, without a separate written engagement agreement. This includes but is not limited to: skip traces, locate services, basic and advanced background checks, business background checks, vehicle searches, DMV and postal searches, location risk assessments, business verification investigations, video review, and standard notary services. By submitting a request for any of these services, you agree to the terms in this Part 2 in addition to Part 1 above.
12. RIGHT TO DECLINE
KB Tenacious, LLC reserves the right to decline any service request at its sole discretion, for any lawful reason, at any time prior to issuing an invoice. Submission of a request does not obligate us to perform services.
13. ATTORNEY-ONLY RESTRICTION — SKIP TRACE AND LOCATE SERVICES
Skip trace and locate services are available exclusively to licensed attorneys, law firms, and authorized legal support staff acting within the scope of a legal matter. By requesting skip trace or locate services, you represent and warrant that:
- You are a licensed attorney or authorized representative of a licensed attorney or law firm
- The information requested will be used solely in connection with a legitimate legal matter
- You have a permissible purpose under applicable law, including but not limited to the Driver's Privacy Protection Act (DPPA) and the Gramm-Leach-Bliley Act (GLBA)
- You will not use or disclose the results for any purpose other than the stated legal matter
KB Tenacious, LLC will verify attorney status prior to fulfilling any skip trace or locate request. Misrepresentation of professional status is grounds for immediate termination of services, forfeiture of any amounts paid, and may constitute a criminal offense.
14. LAWFUL USE CERTIFICATION — ALL INVOICE-TIER SERVICES
By submitting any service request, you certify that:
- The purpose of your request is lawful under all applicable federal and state laws
- You will use any information or report provided solely for the stated purpose
- You will not use any results to stalk, harass, threaten, or harm any individual
- You understand that certain information accessed by KB Tenacious, LLC in fulfilling your request is regulated under federal and state law, including the DPPA, GLBA, and Fair Credit Reporting Act (FCRA)
- You acknowledge that background check reports and related investigative reports provided under these Terms are not consumer reports under the FCRA and may not be used for employment, tenancy, credit, or insurance decisions unless a separate FCRA-compliant process is established
Misuse of results, including use for any unlawful purpose, is a material breach of these Terms and may expose you to civil and criminal liability.
15. NO GUARANTEE OF RESULTS
KB Tenacious, LLC does not guarantee that any investigation will locate a subject, produce a specific result, or yield information of a particular quality or completeness. Investigative outcomes depend on the availability of lawfully accessible information and other factors outside our control. We will make reasonable professional efforts to fulfill your request, and our obligation is limited to those efforts.
16. PAYMENT TERMS
Services are billed at the rates quoted at the time of request. Payment is due upon receipt of invoice unless otherwise stated in writing. Accepted payment methods will be specified on your invoice. Invoices unpaid after thirty (30) days may be subject to a late fee of 1.5% per month on the outstanding balance. In the event of non-payment, you agree to reimburse KB Tenacious, LLC for all reasonable costs of collection, including attorney's fees.
17. NO REFUNDS ON COMPLETED WORK
All sales are final upon delivery of results or completed services. No refunds will be issued for work performed, database queries executed, or reports delivered, regardless of whether the results met your expectations. If a service cannot be completed due to circumstances within our control, a partial or full refund may be issued at our discretion.
18. REPORT USE AND CONFIDENTIALITY
Reports and results provided by KB Tenacious, LLC are for your use only in connection with the stated purpose. You agree not to reproduce, resell, redistribute, or disclose the contents of any report to any third party except as required for the stated lawful purpose or as required by law. Results must be stored securely and disposed of appropriately when no longer needed.
19. NO PI-CLIENT PRIVILEGE
You acknowledge that no private investigator-client privilege exists under Washington State law. Communications between you and KB Tenacious, LLC are not legally privileged. Confidentiality will be maintained as a matter of professional practice, but KB Tenacious, LLC may be compelled to disclose information pursuant to a valid court order, subpoena, or other lawful legal process.
20. VOLUNTARY REPORTING POLICY
KB Tenacious, LLC may, in its discretion, voluntarily report information to appropriate authorities when our work uncovers credible evidence of elder financial abuse, child abuse or neglect, or imminent risk of harm to a person. This is a matter of professional ethics and does not create any obligation or liability on the part of KB Tenacious, LLC.
21. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
